SMS Terms & Conditions

These are the complete program terms for text messages sent by NJ Foot & Ankle Care. They apply only if you have asked for texts. The text program is an optional addition to our educational email newsletter rather than a standalone service: the SMS permission box sits beside the email subscription on our subscribe page and is submitted with it. You can take the emails on their own, and you can end the texts without ending the emails.
What the program sends
The program delivers short educational messages about foot and ankle health — preventive care reminders, diabetic foot self-check prompts, notes on new material published on nufeetfootcare.com, and occasional practice announcements. It is a marketing program in the legal sense of the word, so it is treated as one throughout these terms. It is not a channel for clinical questions, appointment scheduling, or anything urgent, and no message it sends should be read as advice about your own condition.
Who can enroll
You must be at least 18 years old and the regular user of the mobile number you enter. Enrolling a number that is not yours is not permitted.
How you join, and what joining means
Enrollment happens in exactly one place: the SMS permission box on our subscribe page, which you tick yourself, which is never pre-selected, and which is submitted together with the email subscription on that page. Ticking it is your prior express written consent to receive recurring automated marketing text messages from NJ Foot & Ankle Care at the number you provide, including messages sent using an automatic telephone dialing system or comparable automated technology. Providing the number without ticking the box does not enroll you.
The permission is optional, and stays optional
Consent to texts is not a condition of purchase and is not a condition of subscribing to our email newsletter. Nothing on this website is placed behind it. You can leave the box unticked, subscribe to the emails, and keep full use of every page and tool here. Withdrawal runs the same way in reverse: replying STOP ends the texts and leaves your email subscription running.
How often, and what it may cost
Message frequency varies — it follows what we publish rather than a fixed schedule, and we do not promise a set number per week or month. Message and data rates may apply. What you pay is set by your own plan and carrier, not by us, so check your plan if you are unsure.
Stopping the messages, and getting help
Reply STOP to any message from the program to cancel. We will send one final confirmation that you have been unsubscribed, and after that the program sends nothing further. Rejoining later means going back to the subscribe page and giving permission again, exactly as you did the first time.
Reply HELP to any message to receive help information. If replying is inconvenient, or your handset or plan makes keyword replies unreliable, email [email protected] from any device and ask us to remove the number or to explain the program — that route is always open and works just as well as the keyword.
Where the program works, and what carriers guarantee
Delivery depends on mobile networks we do not run, and availability may vary by carrier. Carriers, including T-Mobile, are not liable for delayed or undelivered messages. Coverage gaps, roaming, handset settings, and network congestion can all delay or prevent a message, and none of those are within our control.
The number you give us
Enter a mobile number capable of receiving text messages and belonging to you. Landlines and numbers that cannot receive SMS will simply fail. If you give up the number, change it, or transfer it to someone else, please reply STOP first or tell us at [email protected], so that messages you asked for do not reach a stranger. You are responsible for the accuracy of the number you enter and for any charges your plan applies to messages sent to it.
What we do with your mobile information
Mobile information, opt-in data, and consent will not be shared with third parties or affiliates for their marketing or promotional purposes, and will not be sold. Text messaging originator opt-in data and consent will not be shared with any third parties, excluding aggregators and providers of the text message service — the messaging platform and carriers that technically deliver the message to your handset, which cannot use your number for their own ends. We keep a record of your opt-in and any opt-out, including the exact wording you agreed to and when, as proof that permission was given and when it ended. Our Privacy Policy sets out the whole picture, including how long those records are kept.
Changes to the program, and ending it
We may change these program terms, change what the program sends, or discontinue it entirely. Material changes are posted here with a new revision date before they take effect, and continuing in the program after that is how you accept them. We may also remove an individual number from the program at our discretion — for instance when messages repeatedly fail to deliver, or when the number appears to have changed hands.
Governing law
These SMS Terms are governed by the laws of the State of New Jersey, without regard to its conflict of laws rules, and are subject to the dispute resolution provisions of our Terms & Conditions.
